This work traces, departing from the method of structures of thought, the influence of the doctrines of Duns Scotus and Ockham in 19 th Century dogmatics. Milestones of this transformation are Windscheid’s doctrine on legal rights and Jellinek’s doctrines on public legal rights and the self-limitation of the state, as well as Laband’s distinction between the material sense of law and the formal. This multiplication of formal distinctions dissolves the modern subject in the system. Only a radical approach enables us (...) to understand the sense of legal modernity: the separation made by Scotus and nominalism between object and subject is what in the final instance explains liberal (possessive) individualism and its legal consequences. Since the 1980s, there has been a significant increase in the number of studies concerning Andalusian rural settlements linked to irrigated agriculture, both related to large suburban green belts and to small hydraulic systems. In the vast areas where water is scarce, the settlement apparently would have been concentrated in cities and fortified towns, leaving without population most of the dry lands between them. However, thanks to the intensive survey of one of these regions, La Mancha’s Southeastern area, we are (...) recording a dense rural settlement corresponding to a pattern unknown until now. It consists basically of small villages in plain, devoid of community defense elements, which must have been inhabited by humble peasants, judging by the modesty of the architecture and domestic goods. Surely they make use of the scanty natural resources, which have traditionally oriented the economy of the region towards livestock and rainfed agriculture. In particular, the studied settlement would be related to the demand of wool for the export oriented textile production of the region, within the framework of the commercial expansion of that period. Apparently, most of those villages could have appeared in the eleventh century, disappearing in the middle of the thirteenth century because of the Christian conquest. Their existence would be associated with a general context of population growth that pushed the competition between urban elites and peasants pursuing the privileged agricultural areas, as well as the colonization of less favorable production areas. This book is devoted to discussion of the views of Pierre Musso and starts with a central chapter written by Musso, entitled Network Ideology: from Saint-Simonianism to the Internet. Pierre Musso is a French philosopher and is one of the most original thinkers in the history of the network society. His thought develops a critique of information and communication technologies through their imaginary and social representations and of the information society, based on the network metaphor. The main question on which (...) Musso has focused his attention is how the network metaphor is one of the most powerful ways of understanding the complex societies in which we live. Showing characteristic attention to detail, and drawing on the history of ideas, political philosophy and sociology, Musso traces the genealogy of the network imaginary, and points out that it did not emerge with the Internet. He shows how its modern roots can be found in Henri de Saint-Simon and his disciples, engineers and entrepreneurs such as Michel de Chevalier, and Barthélemy Prosper Enfantin, who developed channel networks, railroads, and the telegraphic network in France in the nineteenth century. In addition to the central piece written by Musso, the book includes a general introduction and six commentaries from experts on information technologies and networks. It displays a wide range of perspectives from a diverse set of authors in terms of nationalities and universities, as well as disciplinary backgrounds. (shrink)

No livro IV, de O mundo como vontade e representação, Arthur Schopenhauer afirma que as ações humanas podem acontecer por motivos e quietivos. As ações que levam em consideração uma cadeia de motivações são sempre auto-dirigidas, tendo em mente que os indivíduos agem pra satisfação dos seus quereres particulares. Tais ações são classificadas pelo autor de egoístas por não levarem em consideração o outro, mas os desejos que preenchem a consciência humana no ato de agir. Nesse primeiro momento a leitura (...) schopenhaueriana da “natureza humana” corrobora com o egoísmo psicológico, pois os indivíduos procuram afirmar a sua vontade de vida por entenderem intuitivamente que a impossibilidade de efetivação dessa pulsão vital denominada vontade promove carência, sofrimento. Porém, Schopenhauer reconhece que existem ações, embora raras, desinteressadas. Nesse momento o egoísmo é suprimido e o agente moral é tomado por uma compreensão metafísica do mundo que o faz agir por compaixão. Nossa pretensão é clarificar como se dá essa passagem do egoísmo psicológico à compaixão metafísica, segundo a visão de mundo schopenhaueriana, recolocando o autor no debate metaético contemporâneo.: In Book IV of The World as Will and Representation, Arthur Schopenhauer asserts that human actions can happen for reasons and quietivos. The actions that take into account a chain of motives are always self-addressed, bearing in mind that individuals act to the satisfaction of his wants private. Such actions are classified by the author as selfish by not taking into consideration the other, but the desires that fill the human consciousness in the act of acting. In that first moment reading Schopenhauer's "human nature" corroborates psychological egoism, since individuals seek to assert their will to live because they understand intuitively that the impossibility of effecting this vital instinct called deficiency promotes ease suffering. But Schopenhauer recognizes that there are actions, although rare, disinterested. At that moment the selfishness and deleted and moral agent is taken by a metaphysical understanding of the world that makes him act out of compassion. Our intention is to clarify how is this passage from psychological egoism to compassion metaphysics, according to Schopenhauer's worldview, placing the author in contemporary meta-ethical debate. Isaac de Pinto was an active financier, economist and homme de lettres. Descending from a Jewish family of Portuguese origin, he lived in Amsterdam, Paris and London. Throughout his life, he enjoyed close relationships and made regular contact with important figures of the European Enlightenment. The main purpose of this article is to show that the concern with the Jewish problems, namely those relating to the difficult economic situation of the Portuguese nation in Amsterdam in the second half of the (...) eighteenth century, is a key factor in explaining the ongoing moral and apologetic dialogues that Isaac de Pinto maintained separately with Voltaire and Diderot. ☆ The authors are most grateful for the comments and suggestions provided by Antoin Murphy and two referees of this journal. Empirical reports on scientific competition show that scientists can be depicted as self-interested, strategically behaving agents. Nevertheless, we argue that recognition-seeking scientists will have an interest in establishing methodological norms which tend to select theories of a high epistemic value, and that these norms will be still more stringent if the epistemic value of theories appears in the utility function of scientists, either directly or instrumentally. RESUMEN El presente trabajo está dirigido a exponer elementos inherentes al modelo de superación profesional del tecnólogo de la salud en laboratorio clínico desde la integración ciencias básicas biomédicas-laboratorio. Entre los métodos teóricos empleados, el analítico-sintético permitió la determinación de los fundamentos epistemológicos y praxiológicos del proceso de superación, el inductivo-deductivo posibilitó la determinación de las categorías que surgen en el proceso investigativo, el sistémico estructural funcional para fundamentar el carácter de sistema del modelo y la modelación con la finalidad (...) de construirlo. Se concluye que se establecen como subsistemas del modelo, la proyección profesional de las ciencias básicas biomédicas, la contextualización profesional de la integración ciencias básicas biomédicas-laboratorio y la valoración contextual de la integración en el proceso de superación, lo que explica el proceso de superación del tecnólogo de la salud en laboratorio clínico. ABSTRACT This paper aims at setting out elements inherent to the health technologist in clinical laboratory’s professional training model from the integration of basic biomedical-laboratory sciences. Among the theoretical methods used, analysis-synthesis allowed establishing the epistemological and praxeological basis of the training process; the inductive-deductive method made it possible to determine the categories that result from the research process and the systemic-structural-functional method was used to support the system-like nature of the model and modelling with the end of building it. In conclusion, subsystems of the model are established: basic biomedical sciences professionals’ aims, professional conceptualization of the integration of basic biomedical-laboratory sciences and the contextual assessment of integration in the training process, which expounds the training process of the health technologist in clinical laboratory. En el intento de defender una interpretación de la ética y la filosofía política de David Hume cercana al utilitarismo clásico, se interpone de un modo clave el llamado problema del “ Sensible Knave ” planteado por este autor al final de su obra más utilitarista, la Investigación sobre los Principios de la Moral . Según la interpretación clásica de este fragmento, la racionalidad utilitarista en el ámbito político colisionaría con la moral volviendo a ésta última inútil. Por tanto, en (...) el ámbito político la defensa de un utilitarismo moral sería una tarea autocontradictoria. Con el fin de mostrar que, primero, Hume no dice nada parecido a esto y, segundo, que incluso señala la forma de superar esta aparente contradicción entre moralidad y racionalidad, se analizan brevemente los argumentos de los que procede básicamente esta interpretación “antiutilitarista” estándar y se defiende una interpretación de la discusión humeana sobre el problema del aparente conflicto entre moralidad y racionalidad, o de los incentivos racionales para el comportamiento inmoral, que permite explicar mejor la posición de Hume sobre este problema. Finalmente, se propone una instancia de superación de la contradicción moralidad/racionalidad por medio de un utilitarismo de la regla atemperado centrado en la idea del “desarrollo progresivo de instituciones artificiales de refuerzo de la moralidad”, que el propio Hume sugeriría en otros lugares en los que aborda el tema de la contradicción aparente entre “morality” y “knavery”. Se proponen también posibles líneas de desarrollo futuro de esta idea, entre ellas su uso para aclarar la posible relación del pensamiento de David Hume con ciertas formas de liberalismo contemporáneo. In a recent paper, Fredérique de Vignemont has argued that there is a positive quale of bodily ownership . She thinks that tactile and other forms of somatosensory phenomenology incorporate a distinctive feeling of myness and takes issue with my defense in Bermúdez of a deflationary approach to bodily ownership. That paper proposed an argument deriving from Elizabeth Anscombe’s various discussions of what she terms knowledge without observation . De Vignemont is not convinced and appeals to the Rubber Hand Illusion (...) to undercut my appeal to Anscombe. Section 1 of this article restates the case against the putative quale of ownership. Section 2 explains why de Vignemonts’ objections miss the mark. Section 3 discusses in more detail how to draw a principled distinction between bodily awareness and ordinary perceptual awareness. This paper proposes and analyzes the psychometric properties of the PREVI-A scale. It describes the process of item development, the factorial structure of the scale, reliability, evidence of validity and diagnostic performance with regard to recidivism risk in juvenile offenders. The sample was made up of 212 juvenile offenders held at detention centers run by the Madrid Agency for Reeducation and Reintegration of Juvenile Offenders, a regional government body. Statistical analyses were used to corroborate the theoretical factorial structure of the (...) PREVI-A, which consists of six risk/protection dimensions based on the Risk-Needs-Responsivity Model, and to obtain empirical support for the reliability and validity of PREVI-A as a tool to assess the risk of recidivism by juvenile offenders in Spain. La primera etapa de este trabajo, parte de la idea del Canon Occidental de Harold Bloom, pero trasladándola al ámbito de la explicación de la conformación y desarrollo de lo que podríamos denominar el Canon liberal, y sostiene que ese canon se cierra con On Liberty; pero, como un pensamiento canónico constituye siempre una realidad dinámica, compleja y en tensión interna permanente, las lecturas e interpretaciones de On Liberty, sobre todo las realizadas en nuestro país desde coordenadas que interpretan a (...) Mill en un sentido no-liberal, iliberal o anti-liberal (como la reciente de Carlos Rodríguez Braun), en realidad, constituyen ejemplos de una lucha interna dentro de ese canon por “abrirlo” y por superar el enorme influjo (“angustia de las influencias” en la terminología de Bloom) que dicha obra ha tenido en el pensamiento occidental. Un ejemplo de la tensión interna dentro del propio canon liberal entre el utilitarismo (y su defensa del valor del individuo y de su bienestar, que es dinámico y en construcción, como elemento crucial de un estado libre, y justo) y el liberalismo (y su defensa del valor primario de la libertad interpretada esencialmente como no intervención y poder limitado) la encontramos en la discusión llevada a cabo por Mill en el capítulo V de Sobre al Libertad acerca de la educación obligatoria. En la segunda parte de este trabajo se exponen y comentan con una cierta amplitud las tesis de Mill sobre este asunto, debido a su relevancia para la interpretación del sentido estricto del liberalismo de Mill. Creemos que es posible articular ambas tendencias sin obligar a Mill a dejar de ser liberal por el hecho de admitir posibles limitaciones a la libertad en circunstancias específicas. Es así por tanto posible sostener que hay buenas razones liberales de raíz utilitarista para sostener dos tesis distintas: (a) que es necesario garantizar una educación universal y obligatoria hasta un cierto nivel, y (b) que caso de noestar adecuadamente garantizada esta educación universal y obligatoria, es aceptable y estaría justificado que el propio Estado no sólo estimulara dicha educación sino que directamente la proporcionara, llegando al extremo de establecer cuáles son los contenidos de esta educación y asegurar su impartición. Finalmente, en la última parte del trabajo, se defiende que no hay contradicción entre esta defensa de una educación obligatoria y universal asumida por el estado y la paralela crítica de Mill al papel de la asunción permanente por parte del Estado de la tarea de educar a los ciudadanos.Para concluir, se defiende el papel central de Mill y de On Liberty en el canon liberal, que debe ser interpretado en un sentido plural, diverso, dinámico y vivo, no necesariamente encerrado o enclaustrado exclusivamente en la tesis, por otra parte central al liberalismo (pero no única) del poder limitado y del rechazo del intervencionismo. Sólo haciendo del liberalismo algo diverso y plural podrán los actuales liberales superar la influencia de Mill y pensar de un modo post-milliano en sentido genuino. (shrink)

Este artículo examina los argumentos de Jacques Derrida contra la fenomenología de Husserl y a favor de la tesis principal del giro lingüístico: la tesis de que no hay pensamiento sin lenguaje. A continuación se defiende que la disolución derridiana de la subjetividad en el lenguaje no es la consecuencia de afirmar el giro lingüístico como tal, sino del modelo de lenguaje que adopta y radicaliza Derrida: el modelo estructuralista de Ferdinand de Saussure. Finalmente, partiendo de las objeciones de Ricoeur (...) se argumenta que la omisión de la dimensión pragmática del lenguaje es la raíz de las principales paradojas de la filosofía postestructuralista de Derrida en la teoría del significado, la referencia y la subjetividad. To this end, what is proposed, based on the limits and crises of State and the constitutionalism that accompanies it, seek the construction of cosmopolitical projects through the resizing of constitutionalism, proposing this in (...) the work from the perspective of the common and human rights, it is essential constitute the common beyond the limits of constitutionalism – state-based or not – since the constitution of the common today takes place in a field in dispute over techno-political practices through cosmotechnical struggles and processes of insurrection, against the backdrop of the impacts of globalization neoliberalism and the disruption of the digital age.
